KidzPAN Terms of Use (Android Beta)

KidzPAN is a parental-control and child-safety service designed to help parents/guardians guide a child's digital wellbeing. The Service includes a Parent App (on the parent/guardian device), a Child App (on the child's device), and related websites and services (together, the "Service").

By creating an account, installing, accessing, or using the Service, you agree to these Terms of Use (the "Terms"). If you do not agree, do not use the Service.

These Terms are separate from our Privacy Policy. Our Privacy Policy explains how we collect and use information. By using the Service, you acknowledge you have read the Privacy Policy.

You must be an adult (or the age of majority in your country) to create a KidzPAN account.

You represent that you are the child's parent or legal guardian (or otherwise have legal authority) to set up, manage, and monitor the child's device using KidzPAN.

The Parent/Guardian is the account holder and controls settings, permissions, and linked child profiles.

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

You must provide accurate information and keep your account information up to date.

If you believe your account has been compromised, contact us immediately.

To provide parental-control functionality, the Child App may require device permissions that Android considers sensitive (for example, Usage Access, Accessibility Service, Notification Access, and Location). You are responsible for:

• reviewing permission explanations during setup and enabling only what you intend to use;
• complying with applicable laws relating to child privacy and monitoring; and
• informing your child (as appropriate for their age) that parental controls are enabled on the device.

Children may not create an account or independently change key monitoring or permission settings without the Parent/Guardian's involvement.

You agree not to misuse the Service. In particular, you will not:

• use the Service to harass, abuse, stalk, or unlawfully monitor any person;
• use the Service in violation of any applicable law, regulation, or court order;
• attempt to circumvent or disable security or access controls;
• reverse engineer, decompile, or attempt to extract source code (except where permitted by law);
• interfere with or disrupt the Service or servers/networks connected to the Service.

Some features may be offered on a free or paid basis. If you purchase a subscription:

• billing and payments are processed by the applicable app store or payment processor;
• your subscription renews automatically unless cancelled in accordance with the app store rules;
• refunds (if any) are handled according to the app store's refund policies.

We may change feature availability, pricing, or subscription offerings from time to time, subject to applicable law and required notices.

The Service (primarily parent/guardian areas and/or our website) may display clearly labelled, contextual (non-targeted) partner pages, listings, or sponsored placements such as educational providers or expert content. Such content:

• is intended for informational purposes and does not constitute professional advice;
• may be curated or sponsored and will be labelled where applicable;
• is not personalised using child data (such as screen activity, messages/notification content, or precise location).

We do not display third-party advertising in the Child App.

The Service, including software, designs, logos, text, and other content, is owned by KidzPAN or its licensors and is protected by intellectual property laws. You receive a limited, revocable, non-exclusive, non-transferable licence to use the Service for personal, non-commercial purposes consistent with these Terms.

If you provide feedback or suggestions, you grant us permission to use them without restriction or compensation, to improve the Service.

KidzPAN is provided on an "as is" and "as available" basis. We do not guarantee that the Service will be uninterrupted, error-free, or that it will prevent all harmful or inappropriate activity.

KidzPAN does not provide medical, psychological, or legal advice. Any educational or expert content is general information only.

To the maximum extent permitted by law, KidzPAN and its officers, directors, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, revenue, or goodwill, arising from or related to your use of the Service.

Where liability cannot be excluded, our total liability will be limited to the greater of: (a) the amount you paid us for the Service in the 12 months prior to the event giving rise to the claim, or (b) NZD $100.

You agree to indemnify and hold harmless KidzPAN from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your misuse of the Service, your violation of these Terms, or your violation of any applicable law (including child privacy or monitoring laws).

We may suspend or terminate access to the Service if we reasonably believe you have violated these Terms, or where required to protect users or comply with law. You may stop using the Service at any time by uninstalling the apps and cancelling any subscription through the app store.

We may update these Terms from time to time. If changes are material, we will provide notice within the Service or by other appropriate means. The Effective Date above indicates when these Terms were last updated.

These Terms are governed by the laws of New Zealand, without regard to conflict of law principles. You agree to the exclusive jurisdiction of the courts located in New Zealand, except where applicable law provides otherwise.
